Please read these Terms before using PlainVM. By downloading, installing or using the application, you agree to them. If you do not agree, do not use the application.

1. Acknowledgement and relationship to Apple’s standard licence

These Terms are concluded between you and Plainum only, and not with Apple. Apple is not a party to these Terms. We, and not Apple, are solely responsible for PlainVM and its content.

If you obtained PlainVM from the Apple App Store, your use is also governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms supplement the Standard EULA and set out terms specific to PlainVM. Where these Terms and the Standard EULA genuinely conflict, the Standard EULA prevails for App Store copies, except that the terms below which grant you broader rights or state PlainVM-specific limitations continue to apply to the extent permitted.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use PlainVM on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and, where applicable, your organisation’s volume licence. You may use PlainVM for personal, educational, commercial and internal business purposes.

3. What you may not do

  • Reverse engineer, decompile or disassemble the application, except to the extent this restriction is prohibited by applicable law.
  • Rent, lease, lend, sell, redistribute or sublicense the application, or offer it as a hosted or “as-a-service” product to third parties, without our written permission.
  • Remove, obscure or alter any proprietary notices.
  • Use the application to infringe intellectual property rights, to violate any operating system licence, or to break any applicable law.

4. No operating systems are included

PlainVM is virtual machine management software only. It does not include, download, distribute, unlock or provide any guest operating system, installation image, licence, product key or activation. You must supply your own installation media and you are solely responsible for holding a valid licence for every operating system and every piece of software you run inside a virtual machine. In particular:

  • macOS guests are subject to the Apple Software Licence Agreement for the relevant version of macOS, which permits a limited number of virtual copies per Apple-branded host. PlainVM enforces a limit of two macOS virtual machines per host, but compliance with Apple’s licence terms remains your responsibility.
  • Windows guests require installation media and a licence obtained from Microsoft or an authorised reseller. PlainVM does not provide, generate or circumvent Windows licences or activation.
  • Linux and other guests are subject to the licences of their respective distributions and components.

Some Windows installation images check for a TPM and Secure Boot. PlainVM cannot present those as real hardware. If you choose to continue, PlainVM will — only after you confirm — write installation settings that skip those checks. Doing so may place the resulting installation outside Microsoft’s supported configurations; that choice, and its consequences, are yours.

5. Your data, backups and the risk of data loss

Virtual machines contain real data, and virtualisation carries real risk. Sudden power loss, a forced quit, a full disk, a disconnected external volume, a guest kernel panic or a failed snapshot restore can leave a virtual disk in an inconsistent state. PlainVM provides snapshots, saved run state and backup packages to help you, but these features are not a substitute for your own backups. You are responsible for maintaining independent backups of anything you cannot afford to lose. To the maximum extent permitted by law, we are not liable for lost, corrupted or unrecoverable data.

6. Capability limits

Some capabilities depend on hardware, on the version of macOS, and on entitlements granted by Apple. macOS guests, saving and restoring run state, and Windows on ARM require Apple silicon. Bridged networking requires a restricted Apple entitlement and is not enabled in the standard build; the application uses NAT networking instead. We describe capabilities as they exist in the current release and do not promise any specific future feature.

7. Updates

We may release updates that add, change or remove features. Updates are delivered through the App Store or through the channel from which you obtained the application, and these Terms apply to them. We are not obliged to maintain compatibility with virtual machines created by older versions, although we aim to.

8. Intellectual property

PlainVM is licensed, not sold. We and our licensors retain all rights, title and interest in the application, including its name, icon and design. Nothing in these Terms transfers ownership to you. Your virtual machines and their contents remain entirely yours; we claim no rights over them.

9. Support

Support is provided by email at support@plainum.net on a reasonable-efforts basis. Apple has no obligation whatsoever to furnish any maintenance or support services for PlainVM.

10. Disclaimer of warranties

To the maximum extent permitted by applicable law, PlainVM is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement. We do not warrant that the application will be uninterrupted or error-free, that defects will be corrected, or that it will work with any particular guest operating system or image.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.

For copies obtained from the App Store: we are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed above. In the event of any failure of PlainVM to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of PlainVM to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to PlainVM, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

11. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, business, goodwill or data, arising out of or relating to your use of or inability to use PlainVM, even if we have been advised of the possibility of such damages. Our total aggregate liability for all claims relating to PlainVM will not exceed the greater of the amount you paid for the application in the twelve months before the claim arose, or US$50. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded by law.

12. Third-party materials and links

PlainVM builds on Apple’s Virtualization framework and other components provided by Apple as part of macOS, which are governed by Apple’s terms. This website may link to third-party sites; we are not responsible for their content or practices.

13. Export control and sanctions

You may not use or export PlainVM except as authorised by the laws of your jurisdiction and of the jurisdiction in which it was obtained. In particular, you represent that you are not located in a country subject to a comprehensive United States government embargo or designated as a “terrorist supporting” country, and that you are not listed on any United States government list of prohibited or restricted parties.

14. Apple as third-party beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms for App Store copies, and that upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Product claims. You and we acknowledge that we, and not Apple, are responsible for addressing any claims by you or any third party relating to PlainVM or your possession and/or use of PlainVM, including but not limited to: (i) product liability claims; (ii) any claim that PlainVM fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. Apple is not responsible for PlainVM or its content and has no obligation whatsoever to address any such claim.

Intellectual property claims. In the event of any third-party claim that PlainVM, or your possession and use of PlainVM, infringes that third party’s intellectual property rights, we, and not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.

15. Government end users

PlainVM and its documentation are “Commercial Items” as defined in 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation”. They are licensed to United States Government end users only as Commercial Items and with only those rights granted to all other end users under these Terms.

16. Term and termination

These Terms apply until terminated. They terminate automatically if you fail to comply with them, and you may terminate at any time by deleting the application. Sections 5, 8, 10, 11, 13, 14 and 17 survive termination.

17. Governing law and severability

These Terms are governed by the laws of the State of Victoria, Australia, without regard to its conflict-of-law rules, and without depriving you of the protection of mandatory consumer law in your country of residence. The courts of Victoria have non-exclusive jurisdiction over any dispute. If any provision is held unenforceable, the remainder stays in force.

Australian consumers. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies those guarantees. Where a guarantee applies and cannot be excluded, but our liability may be limited, our liability is limited to resupplying the software or paying the cost of having it resupplied.

18. Changes to these Terms

We may update these Terms. The effective date and version at the top of this page will change, and the current version will always be published here. Continued use after an update means you accept the revised Terms.

1. 确认事项与 Apple 标准许可协议的关系

本条款仅在你与 Plainum 之间订立,Apple 并非本条款的当事方。PlainVM 及其内容完全由我们而非 Apple 独自负责。

如果你通过 Apple App Store 获取 PlainVM,你的使用同时受 Apple 《被许可应用程序最终用户许可协议》(“标准 EULA”)约束。本条款是对标准 EULA 的补充,规定了 PlainVM 特有的内容。若两者确有冲突,对于 App Store 版本以标准 EULA 为准;但本条款中授予你更多权利或说明 PlainVM 特有限制的内容,在法律允许范围内继续适用。

2. 许可

我们授予你一项个人的、非独占的、不可转让的、可撤销的许可,允许你在你拥有或控制的 Apple 品牌设备上安装并使用 PlainVM,具体范围以 App Store 服务条款以及(如适用)你所在机构的批量许可为准。你可将 PlainVM 用于个人、教育、商业及内部经营用途。

3. 禁止行为

  • 对应用进行反向工程、反编译或反汇编,但适用法律明确禁止此项限制的情形除外。
  • 未经我们书面许可,出租、出借、出售、再分发或再许可本应用,或将其作为托管服务/“即服务”产品向第三方提供。
  • 移除、遮蔽或篡改任何权利声明。
  • 利用本应用侵犯知识产权、违反任何操作系统许可协议或违反适用法律。

4. 不包含任何操作系统

PlainVM 仅为虚拟机管理软件,不包含、不下载、不分发、不解锁、也不提供任何客户机操作系统、安装镜像、许可证、产品密钥或激活服务。你必须自行准备安装介质,并对虚拟机中运行的每一套操作系统与软件持有有效授权承担全部责任。特别说明:

  • macOS 客户机受相应 macOS 版本的 Apple 软件许可协议约束,该协议对每台 Apple 品牌宿主机上可运行的虚拟副本数量有限制。PlainVM 会限制每台宿主机最多 2 台 macOS 虚拟机,但遵守 Apple 许可条款仍是你的责任。
  • Windows 客户机需要你从微软或授权经销商获取安装介质与许可证。PlainVM 不提供、不生成、也不绕过 Windows 许可证或激活。
  • Linux 及其他客户机受其发行版与各组件自身许可协议约束。

部分 Windows 安装镜像会检查 TPM 与安全启动。PlainVM 无法像真实硬件那样提供这两项能力。如果你选择继续,PlainVM 只会在你确认之后写入跳过上述检查的安装设置。这样安装出的系统可能不属于微软支持的配置,该选择及其后果由你自行承担。

5. 你的数据、备份与数据丢失风险

虚拟机中存放的是真实数据,而虚拟化本身存在真实风险。突然断电、强制退出、磁盘写满、外置卷断开、客户机内核崩溃或快照恢复失败,都可能导致虚拟磁盘处于不一致状态。PlainVM 提供快照、运行状态保存与备份包等功能,但这些功能不能替代你自己的备份。对于任何你无法承受丢失的数据,你有责任维护独立备份。在法律允许的最大范围内,我们不对数据丢失、损坏或无法恢复承担责任。

6. 能力边界

部分能力取决于硬件、macOS 版本以及 Apple 授予的 entitlement。macOS 客户机、运行状态保存与恢复、Windows ARM 均需 Apple 芯片。桥接网络需要 Apple 的受限 entitlement,标准版本未开放,应用使用 NAT 网络。我们描述的能力以当前发布版本为准,不承诺任何特定的未来功能。

7. 更新

我们可能发布新增、修改或移除功能的更新。更新通过 App Store 或你获取应用的渠道分发,并同样适用本条款。我们会尽力保持与旧版本所创建虚拟机的兼容性,但不承担该项义务。

8. 知识产权

PlainVM 系许可使用而非出售。我们及我们的许可方保留对本应用(包括名称、图标与设计)的一切权利、所有权与利益。本条款不向你转让任何所有权。你的虚拟机及其内容完全归你所有,我们不主张任何权利。

9. 技术支持

我们通过邮件 support@plainum.net 在合理努力范围内提供支持。Apple 没有为 PlainVM 提供任何维护或支持服务的义务。

10. 免责声明

在适用法律允许的最大范围内,PlainVM 按“现状”与“现有”提供,不作任何明示、默示或法定的保证,包括对适销性、特定用途适用性、准确性、安宁享用与不侵权的默示保证。我们不保证应用不中断或无错误、不保证缺陷必被修复,也不保证其能与任何特定客户机系统或镜像配合工作。

部分法域不允许排除默示保证,因此上述部分内容可能不适用于你。本条款不限制你依法享有的、不可放弃的消费者权利。

对于通过 App Store 获取的版本:在上述免责范围之外,任何明示或法定的产品保证均由我们独自负责。如 PlainVM 未能符合任何适用的保证,你可以通知 Apple,Apple 将向你退还 PlainVM 的购买价款。在适用法律允许的最大范围内,Apple 对 PlainVM 不承担任何其他保证义务;因未能符合任何保证而产生的任何其他主张、损失、责任、损害、成本或费用,均由我们独自承担。

11. 责任限制

在适用法律允许的最大范围内,对于因使用或无法使用 PlainVM 而产生或与之相关的任何间接、附带、特殊、后果性或惩罚性损害,或利润、收入、业务、商誉或数据的损失,我们概不负责,即使我们已被告知此类损害的可能性。我们就 PlainVM 相关全部主张承担的累计责任总额,不超过你在主张发生前 12 个月内为本应用支付的金额与 50 美元中的较高者。本条款不排除或限制因过失导致的人身伤害或死亡责任、欺诈责任,以及其他依法不可排除的责任。

12. 第三方材料与链接

PlainVM 构建于 Apple Virtualization 框架及 macOS 所含的其他 Apple 组件之上,这些组件受 Apple 条款约束。本网站可能链接到第三方站点,我们不对其内容或做法负责。

13. 出口管制与制裁

除非获得你所在法域及获取本应用所在法域法律的授权,你不得使用或出口 PlainVM。你特别声明:你不位于受美国政府全面禁运或被指定为“支持恐怖主义”的国家,且不在美国政府任何禁止或受限名单之列。

14. Apple 作为第三方受益人

你确认并同意:对于 App Store 版本,Apple 及其子公司为本条款的第三方受益人;在你接受本条款后,Apple 有权(并视为已接受该权利)作为第三方受益人对你执行本条款。

产品主张。你与我们确认:对于你或任何第三方就 PlainVM 或你对 PlainVM 的占有及/或使用提出的任何主张,由我们而非 Apple 负责处理,包括但不限于:(i) 产品责任主张;(ii) 关于 PlainVM 不符合任何适用法律或监管要求的主张;以及 (iii) 依据消费者保护、隐私或类似法规提出的主张。Apple 不对 PlainVM 及其内容负责,亦无任何义务处理此类主张。

知识产权主张。如任何第三方主张 PlainVM 或你对 PlainVM 的占有与使用侵犯其知识产权,由我们而非 Apple 独自负责该主张的调查、抗辩、和解与了结。

15. 政府最终用户

PlainVM 及其文档属于 48 C.F.R. §2.101 定义的“商业物品”,由“商业计算机软件”与“商业计算机软件文档”构成。向美国政府最终用户的许可仅作为商业物品进行,且其权利不超过本条款授予其他最终用户的权利。

16. 期限与终止

本条款在终止前持续有效。如你未遵守本条款,本条款自动终止;你也可随时通过删除应用终止本条款。第 5、8、10、11、13、14、17 条在终止后继续有效。

17. 适用法律与可分割性

本条款适用澳大利亚维多利亚州法律,不适用其冲突法规则,且不剥夺你在常住国依强制性消费者法律所享有的保护。维多利亚州法院对相关争议享有非排他管辖权。若任一条款被认定不可执行,其余条款继续有效。

澳大利亚消费者。依据《澳大利亚消费者法》,我们提供的商品与服务附有不可排除的保证。本条款不排除、限制或修改上述保证。在该等保证适用且不可排除、但我们的责任可依法限制的情形下,我们的责任限于重新提供本软件或支付重新提供本软件的费用。

18. 条款变更

我们可能更新本条款。页面顶部的生效日期与版本号将随之更新,最新版本始终发布于此。更新后继续使用即表示你接受修订后的条款。
